SR22 / SR-22 AND NON-OWNER QUESTIONS

WHAT IS AN SR22?

States sometimes require further proof of car insurance. An SR22 is such a form or filing. The state determines when they want a driver to carry the form/filing. Auto insurance companies submit SR22 forms or filings to the state. It’s also called, “proof of Financial Responsibility.” An SR22 is often a requirement for getting Driver’s License privileges reinstated after a Suspension or Revocation. This specialized form your auto insurance provider files with your state’s Department of Motor Vehicles (DMV) proves that you carry the state’s minimum required liability coverage. If your liability coverage cancels, ends or lapses, so does the SR22.

DOES AN SR22 ALLOW ME TO DRIVE?

No. The SR22 is only a part of the requirements to get Driver’s Licenses reinstated. Your state DMV/BMV/DPS will tell you the specifics for you to get reinstated. For instance, you may have a Reinstatement Fee or other additional requirements. The state also tells you how long you’ll need to have the SR22.

HOW LONG DO I NEED AN SR22? 

It depends. Each state has their own rules based upon the underlying reasons, such as DWI, OWI, DUID, too many points or accidents without insurance. Contact your local DMV/BMV/DPS for specifics on your driver’s license status.

HOW DO I GET AN SR22?

Easiest is to ask your existing car insurance provider to add the filing to your policy. If they do not issue SR22 filings, however, then you would switch to an auto insurance company that does. If you own a vehicle, the SR22 lists the vehicle VIN(s) as part of the form. If you don’t own a vehicle but need an SR22, you may qualify for a non-owner policy. Once the SR22 is listed on your policy, the company files it with the state (most often by downloading it to them).

WHO FILES AN SR22?

The insurance company files the form with the state, most often downloading it in a batch of a bunch of SR22s. The state must still process it and does not count it until they do. Your car insurance agent can be a valuable resource in getting this done.

HOW DOES AN SR22 WORK?

Think of an SR22 as a tattletale form, a lookout for the state. The SR22 proves to the state that you carry car insurance. If you let your insurance lapse or cancel the insurance company cancels the SR22 also. Because the state says you need this filing for a certain number of months or years, this is how they track it.

WHY DO I NEED AN SR22?

You need an SR22 because a court or your state’s DMV says you do. Common reasons they require it include:

  • A major ticket, such as driving under the influence of alcohol or drugs (DUIs/DWIs/OWIs/DUIDs) or DWS-driving while suspended
  • Driving without insurance, with or without an accident involved
  • Careless & Imprudent driving or Reckless driving 
  • Multiple minor traffic tickets (too many points on your driving record)

HOW MUCH DOES AN SR22 COST? 

Often the filing itself is not a big deal, a $25 fee perhaps (some car insurance companies also up the rate a bit). The underlying reasons for needing the SR22 filing (your driving record) is often where a lot of the expense comes in.

WHAT IS AN SR26?

An SR26 form essentially cancels an SR22 or SR-22 filing, declaring it no longer active or valid. It’s the form filed by the car insurance company that tells the state an SR22 is no longer valid. Car insurance companies issue SR26s when the underlying policy with SR22 is canceled, non-renewed or lapsed.

DO I HAVE TO DO ANYTHING TO MAINTAIN THE SR22?

To maintain, or keep, the SR22 you simply keep the policy on which it’s issued valid.

DOES AN SR22 MAKE ME A HIGH-RISK DRIVER?

To some insurance companies, yes. You’ll also hear the term, non-standard. The driving record or incident(s) that got you to the point of needing the SR22 is what actually make you a higher risk. Some of this is marketing lingo too. No one wants to be “high risk” so companies that don’t issue SR22s label people as such. Are you a higher risk? According to your driving record, yes; but the SR22 itself just points it out.

IS AN SR22 AN INSURANCE POLICY?

No. The SR22 is not an insurance policy. It is form or filing added to your car insurance policy.

HOW DO I GET AN SR22 WHEN I OWN A CAR?

The simplest way to get an SR22 when you own a car is add it to your existing policy. If you’re with a car insurance company that will not issue one, then you go to a company that will. Since you own a car, your SR-22 must reference, specifically, the vehicle you own to be valid. When you own a vehicle, you are required to have an “Owner’s SR-22.” Car registration is seen and managed by the state. Your This policy will have an SR-22 endorsement attached.

CAN I GET A NON-OWNER POLICY FOR MY SR22 WHEN I OWN A CAR?

No. Think of it this way, if you OWN you cannot NON-OWN. In other words, if you own a registered vehicle, you must carry an owner’s policy with the SR-22 attached. It’s fraudulent to say you don’t own when you do. Do not add to your troubles. Your vehicle is registered to you with the same state that needs to see the SR22 (even if it’s not, it’s not hard to find in another state’s database).

WHAT IF I DON’T OWN THE CAR THAT I GOT THE TICKET OR ACCIDENT IN? HOW DO I GET AN SR22?

If you don not own any vehicle, you likely qualify for a non-owner policy with SR22 attached. If you own a different or another vehicle, you would add the SR22 to that policy.

CAN I GET AN SR22 IF I DON’T OWN A CAR?

Yes. When a state requires you to get an SR22 and you do not own a car, this is what a Non-Owner policy is designed to do. You would get a non-owner policy with an SR22. Pro Tip: If you’re getting a vehicle soon, may want to make sure you can change it to an owner policy. Some non-owner policies do not convert.

DOES A NON-OWNER POLICY COVER ANYTHING I DRIVE?

No. It was designed to help people get their driver’s licenses reinstated when they don’t own a vehicle. Beware the fine print. Non-owner policies do not cover a vehicle owned by you, vehicles available for your every day or regular use, vehicles garaged or kept at your address, or vehicles you don’t own but are considered yours (like a vehicle you haven’t registered in your name yet or the spare family car).

WHAT DOES IT MEAN THAT A NON-OWNER POLICY IS SECONDARY COVERAGE?

In fancy insurance talk, it means that there is an underlying, primary vehicle policy and it is only secondary coverage. In plain English, if you cause an accident, the car-owner’s insurance pays first (primary). Your non-owner policy steps in afterward, as secondary coverage, if the owner’s policy limits are exceeded. These days, not all policies will cover un-named/un-rated drivers. When in doubt, ask before assuming.

CAN I SWITCH INSURANCE COMPANIES IF I HAVE AN SR22?

Yes, you can switch car insurance companies with an SR22. Make sure the company you’re switching to will issue the SR22 without a lapse. If you need an SR22, you’ve got to follow your state’s guidelines for how long you must carry it. They do not care what insurance company issues it. Just make sure there’s no lapse.

IS AN SR22 AN INSURANCE POLICY?

No, an SR22 is not an insurance policy. SR22s are filings with a state issued by a car insurance company. It is proof of an insurance policy showing you have insurance meeting state requirements or higher.

ISN’T MY INSURANCE CARD PROOF OF INSURANCE?

Yes, a car insurance card is also called proof of insurance. Having said this, it’s not the proof a state is looking for when they need an SR22 filing. The car insurance card becomes invalid at any point the car insurance policy is not valid but people still possess the card. The SR22 proves active status of policies till canceled and get canceled by an SR26.

DO YOU DO SAME DAY FILING SO I CAN GET MY LICENSE REINSTATED THE SAME DAY?

This is a two part question. SR22s go in effect when the auto insurance policy they’re attached to begins, or, when they’re added to a policy. So, this is “same day filing.” Next, the tricky part. The state has to review and apply it. Some states, like Georgia, have taken up to 30 days to process their SR22s. Other states that allow attaching the SR22 to the driver’s account tend to process quicker (like Indiana). Remember, the SR22, itself, is not what allows you to drive.

HOW DO I KNOW IF I NEED AN SR22?

Your state sets the standards and is the decider of who needs an SR22. If your driver’s license is suspended or revoked, you’ll need an SR22. Too many points on your driving record or an accident without car insurance can cause suspension (so can driving while impaired or intoxicated).
